The scrapping (separation in parts of a vehicle for use as scrap), salvage or removal of the five ships need a study so that authorization can be issued on environmental impact, in order to ensure prevention measures, mitigation and, where appropriate, compensation for environmental impacts that may be caused:
On June 11, 2018, the company Oceanografía, SA de CV, agreed to initiate the proceedings before the Ministry of Environment and Natural Resources (SEMARNAT).
According to information provided by SEMARNAT, the company Oceanografía, SA de CV, had not carried out any management.
As they are vessels that provide their services within the hydrocarbon sector, their regulation corresponds to the ASEA, based on articles 5 and 6, section II, of the ASEA Law.
Also, any activity of spilling and dumping of any waste into the sea is the responsibility of the Ministry of the Navy, according to the Law of Vertimientos in the Mexican Marine Zones.
In compliance with the National Contingency Plan to Combat and Control Spills of Hydrocarbons and Other Harmful Substances in the Sea, it is the responsibility of the Ministry of the Navy to coordinate and execute said plan and is responsible for the actions to combat any type of contamination by oil spills. and other harmful substances on the coasts, territorial sea and exclusive economic zone.
As it is an oil service vessel (transport of hydrocarbons), the attention of the fire of the vessel, which occurred on September 9, 2018, in the area known as Bahamita, in the Protected Natural Area of Laguna de Términos, is a competence of the Safety, Energy and Environment Agency (ASEA), in terms of environmental impact, by the area in which it was located, as well as hazardous waste, by its generation and / or presence in the vessel.
The above, in view of the fact that on December 20, 2013, the National Agency for Industrial Safety and Environmental Protection of the Hydrocarbons Sector (ASEA) was created, with powers to regulate and supervise, in matters of Industrial Safety, Security Operational and Protection of the Environment, the facilities and activities of the Hydrocarbons Sector.
On August 11, 2014, the Law of the aforementioned Agency was published in the Official Gazette of the Federation and on October 31, 2014, the Internal Regulation of the ASEA was published, which details the set of faculties that must be exercise said Agency.
The fire caused no human losses since the boat was abandoned, the result of stranding occurred on February 4, 2016, due to lack of fuel.
